Study of the official language obligations of federal Crown agents in the province of New Brunswick
This study reviews the sufficiency of current administrative procedures applied by the Federal Department of Justice in New Brunswick to ensure full compliance by Crown agents with official language obligations in the administration of justice. The study begins with an overview of pertinent problems that led to the review and a brief look at study methods. Section 2 explains federal statutory provisions & regulations that apply to the use of the official languages in court processes involving the federal Department of Justice. Section 3 presents review results with regard to federal Crown agents in the province and their appointment, the information available to them about language rights, their knowledge of language rights, determining the language of case files, file transfers, offers of service in either official language, and the language of communications between agents and the Department. The concluding section discusses areas where improvements in administrative arrangements are needed.
