Der Bundestag hat in einer Entschließung vom 28. Januar 2009 vor dem Hintergrund des Subsidiaritätsprinzips Bedenken im Hinblick auf die Rechtsetzungskompetenz der EU geäußert. Die Rechtsetzungskompetenz der EU ist nur eine der aktuellen Rechtsfragen der Transplantationsmedizin aus deutscher und europäischer Sicht. Über die Landesgrenzen hinweg ist chronischer Organmangel ein zentraler limitierender Faktor in der Transplantationsmedizin. Daniela Norba untersucht daher, inwieweit die Wahl zwischen Zustimmungslösung und Widerspruchslösung, die Verpflichtung zur Meldung potentieller Spender, die Zulässigkeit des Rückgriffs auf herzkreislauftote Spender (sog. Non-Heart-Beating-Donor), die Erweiterung der Spendekriterien und die Ausgestaltung der Lebendspende von Bedeutung sind. Vor dem Hintergrund zunehmender Patientenmobilität stellt sich darüber hinaus die Frage, inwieweit sogenannte "Non-Residents" bei Organversagen medizinisch in der Bundesrepublik behandelt werden können. Die Autorin zeigt auf, dass Zugangsbeschränkungen an den nationalen Verfassungen zu messen sind und Einschränkungen europäischem Recht unterliegen."
