  • "L'ordre public matrimonial est tributaire des changements qui affectent le mariage. Le Code Civil de 1804 lui avait donné un caractère institutionnel. Les années 1970 ont marqué un premier tournant en libéralisant et en contractualisant les relations conjugales ; les années 2000 en suggèrent un second qui tend cette fois-ci à libérer les individualités des contraintes subsistantes. En parallèle, le mariage se voit aujourd'hui concurrencé par le pacs et l'essor du concubinage.
