"Les procès pénaux anglais et français, longtemps symboles des procédures accusatoire et inquisitoire, sont aujourd'hui transcendés par d'autres notions, surtout concernant leurs avant-procès. Influencées par la jurisprudence de la CEDH, ces procédures se sont réformées, guidées par l'idéal du procès équitable, considéré comme l'élément fondateur de possibles rapprochements dans le sens d'un modèle universel de procès, voire comme le résultat de ce mouvement de rapprochement. Il s'agissait alors d'interroger la pertinence qu'il y a à considérer le procès équitable comme élément central du rapprochement entre ces systèmes. L'étude des mouvements conduisant à ces rapprochements met en exergue deux étapes. D'abord, ces procédures ont pris conscience de leurs défauts internes, ce qui les a poussées à regarder l'une vers l'autre pour résoudre leur crise. Il en est résulté l'apparition fortuite de points communs structurels comme conceptuels, et de différences culturelles persistantes. Mais au regard des changements contextuels actuels, le constat initial d'une influence réciproque parachevée par la notion de procès équitable n'apparaît pas pleinement satisfaisant. Les modèles traditionnels semblent aujourd'hui incapables de répondre aux pressions extérieures qui leur sont communes. La réponse apportée se transforme donc, au détriment des caractéristiques de la mutation précédente. Ainsi la France et l'Angleterre ne sont plus poussées à regarder l'une vers l'autre pour rechercher des solutions afin de répondre aux problèmes communs, mais tendent à regarder dans une même direction."
