Ausgehend von einer durch Art. 9 Abs. 3 GG den Arbeitnehmern überlassenen Entscheidung, ob sie sich in einer einzigen und mächtigen Koalition oder in einer Vielzahl miteinander konkurrierender Koalitionen zusammenschließen wollen, analysiert Stefan Koop das Gesetzesrecht und das gesetzesvertretende Richterrecht. Er kommt dabei zu dem Ergebnis, dass sich speziell in der Rechtsprechung zahlreiche Ansätze zur Förderung einer Monopolisierung finden.Diese Vorgaben überschreiten indessen den Spielraum, den der Verfassungsgeber zur Ausgestaltung der Koalitionsbetätigungsfreiheit eingeräumt hat. Im Rahmen der den Koalitionen durch Art. 9 Abs. 3 GG eingeräumten Befugnis zur Wahrung und Förderung der Arbeits- und Wirtschaftsbedingungen ihrer Mitglieder hat sich der Staat jeder Monopolisierungsförderung zu enthalten. Etwas anderes kann allein in den Gebieten gelten, in denen die Koalitionen als berufsständische Repräsentanten tätig werden."
