  • "Constantly at the very heart of political debate, the notion of republic seems difficult to perceive on a legal point of view. It is defined by some people as a common form of government which rejects any hereditary handing over of power. For others, this notion is dependent on a real mystic which refers to a set of philosophical values. However the purpose of this thesis is to show that a legal explanation of this concept is possible with the jurisprudence of the constitutional council, an institution which was though considered as being opposite to "republican tradition" at the beginning of the vth republic. Indeed the constitutional council seems to have seized upon the notion of republic, thus confering it an effective characteristic that it did not have before. The fact that this concept is becoming legal is of course a major advance but it has had to adapt to the evolution of society little by little and it has been submitted to democratic requirements. There too, the constitutional council has played an important role by supporting the change and by allowing the "democratisation" of the notion of republic, a "democratisation" which has not yet ended in giving up the republican pattern for the british style of democracy, which is, according to some people more up-to-date and better adapted to the society living at the end of this century."

Definie par les uns comme une simple forme de gouvernement rejetant toute transmission hereditaire du pouvoir, elle releve pour d'autres d'une veritable mystique faisant appel a un ensemble de valeurs philosophiques. L'objet de cette these est de montrer cependant qu'une approche juridique de cette notion est possible, et ce au travers de la jurisprudence du conseil constitutionnel, institution pourtant consideree au debut de la verne republique, comme etant a contre-courant de la "tradition republicaine". Le conseil constitutionnel semble en effet s'etre saisi de la notion de republique, lui conferant ainsi un caractere operatoire qu'elle n'avait pas jusqu'alors. Cette juridicisation constitue bien evidemment un important progres pour cette notion qui a du s'adapter, au fil des annees, a l'evolution de la societe sous la contrainte d'exigences democratiques. La encore, le conseil constitutionnel a joue un role important en accompagnant ce mouvement et en permettant la "democratisation" de la notion de republique, une "democratisation" qui n'a cependant jamais abouti encore a l'abandon du modele republicain au profit du modele de democratie a l'anglo-saxonne pourtant juge par certains plus moderne et mieux adapte a la societe de cette fin de siecle."
