Ainsi dans une première partie, nous avons qualifié l'opération de transfert en une cession conventionnelle de contrat, et précisément, une cession du contrat de travail à durée déterminée du joueur. Cependant, l'opération notamment la justification du paiement de l'indemnité de transfert, si elle naît nécessairement dans le contrat de travail, peut aussi s'exprimer en dehors de ce contrat, à travers le droit fédéral comme la compensation de la perte de qualification et celle liée à la perte du capital image du joueur.
